Welcome to Charbel ("the App"), a Maronite Christian prayer and meditation app operated by Soliton Consulting ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms of Use. If you do not agree, please do not use the App.

1. Description of the App

Charbel provides guided meditations, prayers, stories of saints and the Bible, AI-powered spiritual guidance ("Chat with Charbel"), and AI-powered coffee ground readings ("Fal el Ahwe"). The App is designed for personal spiritual enrichment rooted in Maronite Catholic tradition.

2. Eligibility

You must be at least 16 years old to create an account and use the App. By using the App, you represent that you meet this age requirement.

3. Account Registration

You may create an account using your email address or Apple Sign-In. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly at support@charbel.app if you suspect unauthorized use of your account.

4. Subscriptions and Payments

The App offers a free tier with access to all guided meditations and prayers. A premium subscription ("Charbel Premium") unlocks additional features including Chat with Charbel (1,500 messages per month) and Coffee Readings (35 readings per month).

4.1 Subscription Plans

Charbel Premium is available as an auto-renewable subscription with the following options:

• Monthly Plan: $7.99 USD per month
• Annual Plan: $69.99 USD per year

Prices may vary by region and are displayed in your local currency at the time of purchase in the App Store. Both plans include a 3-day free trial for new subscribers.

4.2 Billing and Renewal

• Subscriptions are billed through Apple's App Store and are subject to Apple's terms and conditions.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price.
• If you are on a free trial, any unused portion of the free trial period will be forfeited when you purchase a subscription.

4.3 Managing Your Subscription

• You can manage or cancel your subscription at any time through your Apple ID settings (Settings > Apple ID > Subscriptions).
• No refunds will be provided for any unused portion of a subscription period, except as required by applicable law or Apple's refund policies.

5. AI-Powered Features Disclaimer

The App includes AI-powered features (Chat with Charbel and Coffee Reading) that use artificial intelligence to generate responses. By using these features, you acknowledge and agree that:

• AI responses are generated by a machine. They are not provided by a real person, clergy member, spiritual director, or licensed professional.
• Not professional advice. AI-generated content is for personal reflection and cultural enjoyment only. It does not constitute religious, spiritual, psychological, medical, legal, or any other form of professional advice.
• No guarantee of accuracy. AI responses may contain errors, inaccuracies, or content that does not align with official Maronite Catholic teachings.
• Coffee readings are for entertainment. The coffee reading feature is a cultural experience inspired by Lebanese tradition. Readings are generated by AI and should not be relied upon for decision-making.
• Seek professional help when needed. If you are experiencing a mental health crisis, emotional distress, or spiritual emergency, please contact a qualified professional, clergy member, or emergency service. The App is not a substitute for professional care.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to the App, its servers, or any related systems.
• Interfere with or disrupt the App's functionality or the experience of other users.
• Use the AI features to generate harmful, abusive, hateful, or inappropriate content.
• Reproduce, distribute, or commercially exploit any content from the App without our prior written consent.
• Reverse engineer, decompile, or disassemble any part of the App.
• Create multiple accounts to circumvent usage limits or for any fraudulent purpose.

7. Intellectual Property

All content in the App — including but not limited to meditations, prayers, audio recordings, text, images, icons, and design — is owned by or licensed to Soliton Consulting and is protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any App content without our express written permission.

AI-generated responses (chat messages and coffee readings) are provided for your personal use only and may not be commercially reproduced or distributed.

8. Content and Availability

We reserve the right to modify, update, or remove any content in the App at any time without prior notice. We do not guarantee uninterrupted or error-free access to the App.

9. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

10. Account Deletion

You may request deletion of your account and associated data at any time by contacting us at support@charbel.app with the subject line "Delete Account." Upon receiving your request, we will delete your account and personal data within 30 days, except where retention is required by law.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOLITON CONSULTING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP;
• ANY CONTENT GENERATED BY THE AI FEATURES;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP;
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA.

13. Indemnification

You agree to indemnify and hold harmless Soliton Consulting, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App or violation of these Terms.

14. Changes to These Terms

We may update these Terms of Use from time to time. We will notify you of material changes by posting the updated terms within the App and updating the "Last updated" date. Your continued use of the App after any changes constitutes your acceptance of the revised terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Paris, France.
